PLEASE READ AND REVIEW THE REAL ESTATE TERMS THOROUGHLY PRIOR TO BIDDING ON ANY PROPERTY. IF YOU HAVE NOT READ AND UNDERSTAND THESE TERMS, DO NOT BID. BY BIDDING ON THE PROPERTY, BUYER AGREES TO ALL TERMS AND CONDITIONS SET FORTH AND ENTERS INTO A CONTRACTUAL AGREEMENT TO PURCHASE THE PROPERTY UNDER THE FOLLOWING TERMS AND CONDITIONS:

Auction Location: The Silo Event Center- 110 John Rives Road, Hopkinsville, KY 42240

Pre-Bidding: Pre-Bidding Begins: Thursday July 7th @ 8AM CT; Pre-Bidding Ends: Thursday July 14th @ 5:30PM CT

Conduct of the Auction: This property will be offered in TWO (2) individual tracts, combinations or as a total 97 +/- acre unit. There will be open bidding on all tracts and combinations during the auction as determined by the Auctioneers. Bids on tracts, tract combinations and the total property may compete. The property will be sold in the manner resulting in the highest total sale price.        

Seller's Acceptance: Property will sell with the high and final bid(s) subject to the Seller's approval.

Acceptance of Bid Prices: All successful bidders will be required to enter into Purchase Agreements at the auction site immediately following the close of the auction. Purchase Agreements are available for review prior to the auction.

Buyer's Premium: There will be NO Buyer's Premium added to the final bid and will be included in the total sales price.

Taxes: 2022 taxes will be prorated between Buyer(s) and Seller(s) at closing.

Down Payment: 10% as down payment on the day of the auction with the balance in cash at closing on or before closing or before 45 days. The down payment may be in the form of cashier’s check, personal check, or corporate check.  Down payment is not refundable. Your purchase is not subject to financing. If winning bidder is an online bidder, the down payment must be wire transferred or delivered by check by July 15th at 5 PM.

Date of Closing: The closing will take place on or before 45 Days.

Possession: Possession will take place at closing.

No Contingencies: This Real Estate contract is not contingent on or subject to Buyer’s financing, appraisal, survey or inspections of any kind or any other contingencies as agreed to by bidders at registration prior to bidding.

YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, SO BE SURE YOU HAVE ARRANGED FINANCING, IF NEEDED, AND ARE CAPABLE OF PAYING CASH AT CLOSING.

Zoning & Easements: Property is being sold subject to any and all easements of record. Property is subject to all state and local zoning ordinances.

Age Requirement: All bidders must be at least 18 years of age or older.

Bidder Information & Security: All registration information the bidder provides to Bolinger Real Estate & Auction, LLC shall be current, complete & accurate. All bidders are responsible for any bids placed under their bidding numbers and password. The security of bidder information is the responsibility of the bidder. Bidders must notify Bolinger Real Estate & Auction, LLC if they believe that their bidder number and password have been compromised.

Conduct of the Auction: Bolinger Real Estate & Auction, LLC reserves the right to reject any and all bids for any reason and also reserves the right to cancel this auction, or remove any item or lot from this auction prior to the close of bidding. All decisions of Bolinger Real Estate & Auction are final.
