Terms & Conditions

PLEASE READ AND REVIEW THE TERMS & CONDITIONS THOROUGHLY PRIOR TO BIDDING IN ANY AUCTION. IF YOU HAVE NOT READ AND UNDERSTAND THESE TERMS, DO NOT BID. BY BIDDING IN THE AUCTION, BUYER AGREES TO ALL TERMS AND CONDITIONS SET FORTH AND ENTERS INTO A CONTRACTUAL AGREEMENT TO PURCHASE ANY ITEMS WON DURING THE AUCTION UNDER THE FOLLOWING TERMS AND CONDITIONS:

Online Bidding:  Bidding Begins: 6/3/2026 @ 12:00 PM CST.

Bidding Closes: Lots begin closing 6/10/2025 @ 12:00 PM CST.

Auction Ending: Beginning at the stated closing time, the auction software will conclude bidding for 4 lots each minute in catalog order with the following exception: if a bid is placed in the last five (5) minutes remaining for that auction lot, bidding for that lot will remain open for an additional five (5) minutes.

Buyer's Premium: There will be a 10% Buyer's Premium added to the final bid and will be included in the total sales price.

Taxes: Applicable KY Sales tax applies unless an exemption certificate is provided before checkout.

Payment: Payments by ALL successful bidders can be paid by cash, check, or credit card (plus a 3% processing fee).  All successful online bidders will receive their invoices via email from Bolinger Real Estate and Auction at the conclusion of the auction and payments are due on receipt. Payments can be made when items are picked up during the designated pick-up time. If pickup arrangements are not made within 48 hours after the auction end time, then the credit card on file will be charged for the full invoice total plus the 3% processing fee.

Pick Up Time & Location: Within 48 hours of the close of the auction event, the winning bidder for the property shall receive an e-mail from Bolinger Real Estate & Auction which will detail a date, a time, and a location for the retrieval of the personal property, subject to further specific arrangements of the parties.

Refunds: No refunds or adjustments will be made once an item has been removed from the auction site. All refunds and adjustments are solely at the discretion of the auction company.

Disclaimer & Absence of Warranties: All information contained in this brochure and all related materials is subject to the Terms and Conditions outlined in the Purchase Agreement. The property is being sold “AS IS, WHERE IS” basis, and no warranty or representation, either express or implied, concerning the property is made by the Seller or Auction Company. Each potential bidder is responsible for conducting his or her own independent inspections, investigations, inquiries, and due diligence concerning the property. The information presented in the brochure, website and all other mediums is believed to be accurate but is subject to verification by all parties relying on it. No liability for its accuracy, errors, or omissions is assumed by the Seller or the Auction Company. All sketches & dimensions in this brochure are approximate. Except for any express warranties set forth in the sale documents, purchaser(s) assume all risks thereof & acknowledges that in consideration of the other provisions contained in the sale documents, Seller & Auction Company make no warranty or representation, express or implied or arising by operation of law, including a warranty of merchantability or fitness for a particular purpose of the property, or any part thereof, and in no event shall Seller or the Auction Company be liable for any consequential damages. Conduct of the auction & increments of bidding are at the direction & discretion of the auctioneer. The Seller & The Auction Company reserve the right to preclude any person from bidding if there is any question as to the person’s credentials, fitness, etc. All decisions of the auctioneer are final.

Property Inspection: Each potential bidder is responsible for conducting, at their own risk, their own independent inspections, investigations, inquiries, and due diligence concerning the property. Further, Seller disclaims any and all responsibility for Buyer’s safety during any physical inspection of the property. No party shall be deemed an invitee of the property by virtue of the offering of the property for sale. The designated inspection time is by appointment only. Contact the Auctioneer to schedule.

Age Requirement: All bidders must be at least 18 years of age or older.

Bidder Information & Security: All registration information the bidder provides to Bolinger Real Estate & Auction, LLC shall be current, complete & accurate. All bidders are responsible for any bids placed under their bidding numbers and password. The security of bidder information is the responsibility of the bidder. Bidders must notify Bolinger Real Estate & Auction, LLC if they believe that their bidder number and password have been compromised.

Technology Disclaimer: Bolinger Real Estate & Auction, its affiliates, partners and vendors, make no warranty or guarantee that the online bidding system will function as designed on the day of sale. Technical problems can and sometimes do occur. If a technical problem occurs and you are not able to place your bid during the live auction, Bolinger Real Estate & Auction., its affiliates, partners and vendors will not be held liable or responsible for any claim of loss, whether actual or potential, as a result of the technical failure. I acknowledge that I am accepting this offer to place bids during the auction over the Internet or over the phone.

Conduct of the Auction: Bolinger Real Estate & Auction, LLC reserves the right to reject any and all bids for any reason and also reserves the right to cancel this auction or remove any item or lot from this auction prior to the close of bidding. All decisions of Bolinger Real Estate & Auction are final.

YOUR BID ON THIS AUCTION INDICATES BOTH AN UNDERSTANDING AND AN ACCEPTANCE OF THE TERMS OF THIS CONTRACTUAL AGREEMENT BETWEEN YOURSELF AND BOTH THE SELLER AND BOLINGER REAL ESTATE & AUCTION AND THAT YOU, AS THE BIDDER, ARE PREPARED TO PURCHASE THE PROPERTY UNDER THE TERMS AND CONDITIONS OF THIS AUCTION.
